Former ANTHRAX Guitarist Threatens To Sue ROADRUNNER RECORDS
February 17, 2003Former ANTHRAX guitarist Dan Spitz has threatened to sue Roadrunner Records over the "unauthorized use of a copyrighted photograph" belonging to Spitz on the parody site Infernal Combustion.
Susanne Birbrair, Spitz's manager, has fired off a letter to Roadrunner's legal department, stating that "No one is authorized to exhibit, reproduce, transmit, or otherwise distribute the above-mentioned work without the express written permission of Daniel Spitz, which permission Daniel Spitz has not granted."
The photo, which featured Spitz holding the same kind of guitar that the diminutive Messianic Jew once claimed gave him a "burning sensation" during the years that followed his split with ANTHRAX, has since been replaced by a different one featuring a yellow smiley face superimposed over Spitz's head with the accompanying message "Hi! I threaten web sites under assumed names."
Spitz is currently recording an album with his new band SEVEN X SEVENTY, which the guitarist has claimed will feature contributions from IRON MAIDEN drummer Nicko McBrain (photo#1, photo#2, photo#3) and ex-MEGADETH bassist Dave Ellefson. McBrain and Ellefson have since issued a statement through Sanctuary Artist Management denying their involvement in the project.
